Same Sex Marriage Legal in Virginia: Is NC next?

This morning, the US Supreme Court denied petitions seeking the Court’s review of same sex-marriage cases from several states.  The Supreme Court’s decision leaves in place decisions from lower courts that invalidated same-sex marriage bans in Indiana, Wisconsin, Utah, Oklahoma, and Virginia.  Same-sex marriages will be legal in these states as soon as today.

Because North Carolina is part of the same federal court circuit as Virginia, the Supreme Court’s decision to deny review two cases arising out of the 4th Circuit Court of Appeals is binding on North Carolina.  This means that the invalidation of North Carolina’s ban on same-sex marriage is imminent as plaintiffs in four cases challenging NC’s Amendment One will move quickly to seek a formal ruling that the state’s ban is unconstitutional.   For more information, click here.
